PLEASE READ THESE TERMS OF USE (THE “TERMS”) CAREFULLY. THIS WEBSITE, WWW.CONFORMATIONALAESTHETICS.COM, INCLUDING THE INFORMATION, PRODUCTS, CONTENT, AND RESOURCES AVAILABLE OR ENABLED VIA THE SITE MADE AVAILABLE BY CONFORMATIONAL AESTHETICS (COLLECTIVELY, THE “SITE”), IS GOVERNED BY THESE TERMS. Throughout the Terms, the terms: (i) “Conformational Aesthetics,” “we,” “us,” or “our” refer to Conformational Aesthetics; and (ii) “you,” “your,” or “user” refer to you and each visitor of the SITE. THE TERMS GOVERN THE USE OF THE SITE AND APPLY TO ALL USERS VISITING THE SITE BY ACCESSING OR USING THE SITE IN ANY WAY. BY BROWSING THE SITE, YOU REPRESENT THAT (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS, (2) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH CONFORMATIONAL AESTHETICS, AND (3) YOU ARE AN INDIVIDUAL AND NOT REGISTERING FOR OR ON BEHALF OF A COMPANY. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS, YOU MAY NOT ACCESS OR USE THIS SITE.

THE MARKETPLACE FEATURES OF THE SITE ARE INTENDED FOR INDIVIDUAL USE. IF YOU ARE A CORPORATE USER OR USING THE SITE ON BEHALF OF A COMPANY, YOU ARE NOT PERMITTED TO CREATE AN ACCOUNT ON THE SITE OR USE THE SITE TO PURCHASE PRODUCTS. PLEASE CONTACT US AT info@conformationalaesthetics.com. IF YOU WOULD LIKE TO BECOME A RESELLER. CONFORMATIONAL AESTHETICS RESERVES THE RIGHT TO TERMINATE YOUR ACCESS TO THE SITE IF IT DETERMINES THAT YOU ARE ACTING AS A RESELLER.

PLEASE BE AWARE THAT SECTION 15 OF THESE TERMS CONTAINS PROVISIONS GOVERNING HOW CLAIMS BETWEEN YOU AND US ARE RESOLVED, INCLUDING AN ARBITRATION AGREEMENT. BY AGREEING TO THESE TERMS, YOU (1) WAIVE YOUR RIGHT TO SEEK RELIEF IN COURT OR HAVE A JURY TRIAL AND (2) AGREE TO PURSUE CLAIMS AGAINST US ONLY ON AN INDIVIDUAL BASIS, NOT AS PART OF A CLASS ACTION OR SIMILAR PROCEEDING.

Use of the Site

The Site, which includes the information, products, content, and resources available on the Site, is protected by intellectual property laws throughout the world. Unless otherwise specified by Conformational Aesthetics in a separate license, your right to use the Site is subject to these Terms.

Certain Restrictions

You agree that:
(a) you shall not license, sell, rent, lease, transfer, assign, reproduce, distribute, host, or otherwise commercially exploit the Site or any portion of the Site;
(b) you shall not frame or utilize framing techniques to enclose any trademark, logo, or other intellectual property (including images, text, page layout, or form) of Conformational Aesthetics;
(c) you shall not use any metatags or other “hidden text” using Conformational Aesthetics’ name or trademarks;
(d) you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile, or reverse engineer any part of the Site except to the extent the foregoing restrictions are expressly prohibited by applicable law;
(e) you shall not use any manual or automated software, devices, or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools, or the like) to “scrape” or download data from any web pages contained in the Site;
(f) you shall not access the Site in order to build a similar or competitive website, application, or service;
(g) except as expressly stated herein, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means; and
(h) you shall not remove or destroy any copyright notices or other proprietary markings contained on the Site.

Any future release, update, or other addition to the Site shall be subject to these Terms. Conformational Aesthetics and its suppliers and service providers reserve all rights not explicitly granted in the Terms. Any unauthorized use of the Site terminates the licenses granted by Conformational Aesthetics pursuant to these Terms.

Third-Party Materials

As a part of the Site, you may have access to materials that are hosted by another party. You agree that it is impossible for Conformational Aesthetics to monitor such materials and that you access these materials at your own risk.

Responsibility for Content

Types of Content. You acknowledge that all content is the sole responsibility of the party from whom such content originated. This means that you, and not Conformational Aesthetics, are entirely responsible for all content that you upload, post, email, transmit, or otherwise make available through the Site (“User Content”), and that you and other users, and not Conformational Aesthetics, are similarly responsible for all User Content that you and they make available through the Site.

No Obligation to Pre-Screen User Content. You acknowledge that Conformational Aesthetics has no obligation to pre-screen User Content, although it reserves the right in its sole discretion to pre-screen, refuse, or remove any User Content. By accessing the Site, you hereby provide your irrevocable consent to such monitoring.

Storage. Unless expressly agreed to by Conformational Aesthetics in writing elsewhere, Conformational Aesthetics has no obligation to store any User Content. Conformational Aesthetics has no responsibility or liability for the deletion or accuracy of any User Content.

Ownership

Conformational Aesthetics Ownership. You agree that Conformational Aesthetics and its suppliers own all rights, title, and interest in the Site, including the information, products, content, and resources available on the Site.

Trademarks. Conformational Aesthetics’ stylized name and all related graphics, logos, trademarks, and trade names used in connection with the Site are the trademarks of Conformational Aesthetics and may not be used without permission.

Feedback. You hereby grant Conformational Aesthetics a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully sublicensable right and license to use, reproduce, perform, display, distribute, adapt, modify, and create derivative works of any feedback you provide.

Registration Data

To access certain features of the Site and/or make purchases, you must create an account (“Account”). You agree to provide true, accurate, current, and complete information about yourself.

Termination

Conformational Aesthetics may suspend or terminate your access to the Site at any time if you materially breach these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California. Venue shall lie exclusively in the state and federal courts of San Diego, California.
